The length of time it takes to finalize a divorce is influenced by the parties and how amenable they are to working together. Until recently, even if the parties wanted to expedite the divorce, Connecticut required a 90-day waiting or “cooling off” period. Fortunately, a relatively new law allows parties to waive the 90-day waiting period. This “Nonadversarial Divorce Law”, was covered in The New Haven Register when it reported on the changes in the law last year, noting that some couples are now afforded “simpler and quicker” divorces.
Qualifying for a Speedy Divorce
The law came into effect on October 1, 2015. Very few Connecticut residents realize that the 90-day waiver exists. To waive the period, the parties must have a dissolution of marriage agreement in place. Any agreement must address all aspects of the divorce. This is made clear on the Motion to Waive Statutory Time Period Form posted on the Judicial Branch website.
The motion to waive the statutory time period differs from another newly available expedited divorce option. Without an agreement to waive the 90 days, Parties may obtain a divorce in 35 days or less if they meet certain eligibility factors. These factors include being married 8 years or less, and having a total property value of less than $35,000. Most couples’ situation will not meet these requirements. Couples who have an agreement and wish to expedite their divorce, but have a longer marriage and/or more assets can simply sign an agreement to proceed to judgment prior to the 90-day period.
